LMT GROUP S.A.S. – LAST KINGS COLOMBIA BELOW, THE GENERAL TERMS AND CONDITIONS THAT REGULATE THE ACCESS, USE, REGISTRATION AND PERFORMANCE OF COMMERCIAL TRANSACTIONS ON THE GOODS AND SERVICES OFFERED BY LAST KINGS COLOMBIA WITHIN OR THROUGH THE WWW.LASTKINGSCOL.COM PORTAL ARE DESCRIBED BELOW, AND OF THE MOBILE APPLICATIONS THAT IT MANAGES (hereinafter THE “PORTAL”) AND/OR OTHER DOMAINS OR PORTALS RELATED TO LAST KINGS COLOMBIA. LMT GROUP S.A.S. is a commercial company legally created under the laws of the Republic of Colombia, which for all purposes of this document shall be called “LAST KINGS COLOMBIA.” Any person who registers on the Portal and/or who carries out a commercial transaction on it, declares they understand and accept each and every one of the provisions established in these Terms and Conditions. Consequently, all acts and contracts that are calibrated on or through the Portal shall be subject to the provisions contained in this document and the applicable current Colombian legislation. These Terms and Conditions shall be applicable to the “Client(s)”, as well as visitors to the Portal, potential buyers and buyers. Any person who does not accept these Terms and Conditions and the LAST KINGS COLOMBIA Data Processing Policy, which are mandatory and binding, shall refrain from using, accessing, registering or carrying out any act of commerce on or through the Portal.

  1. CUSTOMER REGISTRATION ON THE PORTAL

The purpose of registering on the Portal is to allow the Client to register, access, use and carry out commercial transactions through it. The Client has two (2) options to register:

Register through third party applications, such as, but not limited to: Facebook, Google, Instagram or LinkedIn (hereinafter “Third Party Applications”). In this case, the Client authorizes and understands that LAST KINGS COLOMBIA may collect other types of information that are available in their account(s) registered in the Third Party Applications, such as, but not limited to, name and surname, profile photo(s), country and city of residence, email, telephone and date of birth, among others. The Client declares they understand and accept that the Third Party Applications have their own terms and conditions of use and privacy policies, which LAST KINGS COLOMBIA is not party to. LAST KINGS COLOMBIA does not interfere with the features, activities, advertisements, behaviors and/or published content of these Third Party Applications, and the transactions that the Client can carry out through said Third Party Applications.

Register directly through the Portal, where the provision of the Client’s basic personal data shall be requested, including but not limited to:

(i) Name and surname

(ii) Citizenship card or identification number (iii) Date of birth

(iv) Gender

(v) Email

(vi) Password

In the event that the Client makes a purchase, they shall provide in addition, among others:

(i) Address, municipality and department

(ii) Landline and/or mobile phone

The Client, when entering their data, declares under oath that they correspond to true and current information. LAST KINGS COLOMBIA is not responsible for the accuracy of the personal data granted and/or supplied by Clients. Each Client may be the holder of a single account on the Portal. In the event that LAST KINGS COLOMBIA prove that an account or registry is being used for fraudulent, improper or purposes contrary to good faith and/or good practice, or cannot confirm its origin,

LAST KINGS COLOMBIA shall be empowered to eliminate or suspend the registration on the Portal, as well as to initiate legal actions that may arise. Access, use, registration and commercial transactions carried out through the Portal shall be carried out by persons of legal age. Customer registration data shall be collected, stored and used by LAST KINGS COLOMBIA in accordance with the LAST KINGS COLOMBIA Personal Data Treatment Policy available at www.lastkingscol.com or via the following link https://lastkingscol.com/en/terms-and-conditions/. Only people who have the legal capacity to contract and be bound, that is, those over eighteen (18) years of age, may access, use, register or carry out any act of commerce in or through the Portal. Consequently, upon registration, the Client declares and certifies that LAST KINGS COLOMBIA is not responsible for the information provided by its Clients, including their date of birth and identification number, among others. If operations and/or transactions are found to be carried out by minors, they shall be understood to be carried out under the responsibility of their parents and/or guardians. Performing purchases on the Portal shall require, depending on the selected payment method, the provision of financial information, including specific information on the credit or debit card, telephone number and shipping address. LAST KINGS COLOMBIA does not store or save any information related to bank details or financial information of the Client. LAST KINGS COLOMBIA reserves the right, at any time, to:

(i) Contact and request additional information in order to corroborate personal data

(ii) Temporarily or permanently suspend the purchases of those customers whose data could not be confirmed, are suspicious or are identified as possibly fraudulent

(iii) Delete any previously accepted registration

(iv) Reject any new request, without being obliged to communicate or state the reasons for their decision, and without generating any right to compensation or compensation in favor of the Client.

  • SECRET PASSWORD

Once registered on the Portal, the Client shall enter the secret code that has been assigned to them to enable entrance to their account and/or to make purchases. This will allow the Client’s personalized, confidential and secure access to the Portal. The secret key is personal and non-transferable, which is why all operations carried out via the account are, and shall in every instance, be the sole responsibility of the Client. The delivery of the Secret Code to third parties or its use shall not imply any responsibility for LAST KINGS COLOMBIA. The Client reserves the right to change the access code at any time, for which they shall abide by the procedure established on the Portal. In the event that the Client becomes aware of any improper access and/or use of their account by a third party, they shall immediately notify the LAST KINGS COLOMBIA Client service department through any of the service channels provided: infolastkings@gmail.com or telephone +57 3118751811

  • PROCEDURE TO MAKE USE OF THIS PORTAL

The Portal provides information on the steps to be followed to purchase Products through the Portal, as well as the different service channels available to identify, update and correct the Client’s data, according to the LAST KINGS COLOMBIA data treatment policy. The use of the bank cards accepted on the Portal is subject to the existing contract between the Client and the issuing Bank, without LAST KINGS COLOMBIA holding any responsibility or interfering in relation to the aspects indicated therein. Information on the Client’s bank accounts, credit cards and debit cards are managed exclusively by the third parties that provide this service for LAST KINGS COLOMBIA, without LAST KINGS COLOMBIA holding any responsibility in the administration, operation and/or storage thereof. Any claim related to the use and payment through bank cards shall be made directly to the indicated third party. In the event that LAST KINGS COLOMBIA identifies that the Client is making inappropriate or improper use of the Portal, such as, but not limited to, two or more repetitive cancellations, fraud, among others, regardless of the means of payment used, LAST KINGS COLOMBIA shall have the power to block the Client, without the Client having the power or the right to request any type of compensation for said situation. When the Client has any doubts or concerns regarding the purchase process on the Portal, they may communicate with the customer service channels, who shall provide support and assistance.

  • PURCHASE CONSENT
  1. The consent of the Client is manifested with the completion and acceptance of each of the purchase steps of the Portal, and is completed with the final purchase statement after having reviewed the order summary in which each of the items are detailed, including Products, their individual price, shipping costs (if applicable), information regarding third parties, and the total sum that the Customer shall pay. At the time of placing the order, LAST KINGS COLOMBIA shall issue a confirmation and acknowledgment of receipt of the order to the email provided by the Client at the time of registration. 

 

  1. PROMOTIONS

3.1. Promotional or Advertising Communications The Client expressly authorizes LAST KINGS COLOMBIA and/or its suppliers, associated or related, to be sent newsletters to the email registered on the Portal, which may include promotions according to the characteristics of each Client, purchases made and links visited, and the authorization given at the time of registration on the Portal. The Client may request the suspension of all promotional or advertising communication sent to their email by sending a request to: infolastkings@gmail.com through our customer service channels or via the unsubscribe button situated at the bottom of each newsletter.

3.2. Use of Coupons

LAST KINGS COLOMBIA may, at any time, issue discount coupons to promote the acquisition of Products marketed through the Portal. The use of a discount coupon is not cumulative with other promotions or discounts unless otherwise stated. It is not transferable to third parties, nor can it be exchanged for the amount paid or other Products, and it can only be used once by each Client registered on the Portal. The discount coupon shall indicate the effective date, and the other conditions that apply, such as, but not limited to validity, conditions, selected Products, minimum purchases required, among others. The use and application of discount values ​​described in the coupon are 100 percent subject to its correct use. That is, before completing the purchase, the user shall CLICK on the “USE COUPON” button for the discount to be applied to the respective purchase. If the coupon is used correctly, the value of the discount shall be reflected in the shopping cart. No coupon shall be redeemable or refundable in cash, check, refund to the credit or debit card, and in general by any other means of payment, without prejudice to the provisions of paragraph (i) below. In the event that the Client uses the coupon and subsequently proceeds to exercise the right of return on the purchased Product, one of the following options shall be applied:

If the coupon was created for a particular Client and for their exclusive and personal use, a new coupon shall be issued to be used for another purchase, under the same conditions as the initial coupon.

If the coupon was created for the general public, for all or for a special segment of customers who are already registered, for advertising purchases in mobile applications – that is it was not created for a particular customer – the coupon will expire with its use in the first purchase and consequently shall not be redeemable.

3.3. Validity and Conditions of Promotions

The offers and/or promotions shall have the validity indicated and communicated to the Client. In case of being subject to inventory availability, it shall be understood that the promotion extends until the inventory destined for that offer is exhausted or until the effective date indicated for it, whichever comes first. Promotions are not cumulative with other promotions or discounts unless otherwise specified on the Portal or in the promotion. When the Client uses the coupon or redeems it (CLICK on the “USE COUPON” button) they fully accept the terms and conditions of said offers and promotions.

  1. INTELLECTUAL PROPERTY

The intellectual property rights over the Portal, and especially the content published therein, are the exclusive property of LAST KINGS COLOMBIA or have been licensed to it by its third party providers and/or allies. The reproduction, copy, alteration, modification, disclosure, total or partial reuse of all material published on the Portal is expressly prohibited without the express prior written authorization of LAST KINGS COLOMBIA. 

  1. PRODUCTS

5.1. Sizes

When selecting a Product, the customer shall choose and select their size on the Portal. The Client declares they understand and accept that the size indicated on the Products and on their packaging may differ from what the Client normally wears in Colombia, since the manufacturer operates by their own sizes. Sizes are in accordance with the international custom of the country of origin of the manufacturer or producer. It is important to note that in the case of footwear, sizes may vary depending on whether the Product are shoes, sandals, boots or tennis shoes, as well as the type of socks paired with them. It is the Client’s responsibility to carefully review the indications provided on the Portal and in case of any doubt, they can request the information they deem necessary through the LAST KINGS COLOMBIA Client service department. The change of the Product for a different size will be appropriate in accordance with the provisions of paragraphs 7.1 “Right of Return” and 7.4.1 “Incorrect Size”.

5.2. Colors

LAST KINGS COLOMBIA commits to doing their utmost in ensuring the colors of the Products seen in the photos are as close to reality as possible. However, the color of the Products may change or vary due to factors such as light, contrast, the quality of the computer monitor on which they are viewed, among other factors. LAST KINGS COLOMBIA cannot guarantee that the colors displayed on the Portal correspond exactly to those of the actual Products.

5.3. Out of Stock Inventories

The Client declares they understand and accept that between the moment in which the selection of the Product is made on the Portal and the moment in which the acceptance of the transaction by the financial entity is actually made, the selected product may be out of stock. In the event that such a situation arises, the Client is empowered to request a reversal of the transaction and be refunded the amount of the out of stock Product. Should such a situation arise, LAST KINGS COLOMBIA shall inform the Client in a timely manner, but this does not denote responsibility on the part of LAST KINGS COLOMBIA, nor does it empower LAST KINGS COLOMBIA to request compensation for damages from the Client.

5.4. Prices

All the prices of the Products published on the Portal are expressed in Colombian pesos and correspond to the unit price of each Product. Prices do not include additional shipping costs, or any other additional costs. Additional expenses, such as taxes or shipments that are a direct result of the purchase shall be indicated and reported in the order, prior to the acceptance and confirmation of the order.

5.4.1. Crossed-out Prices

When the Portal shows a crossed-out price on the Product, and instead another sale price is indicated, said crossed-out price corresponds to the price that the Product previously had, and the price that is not crossed out corresponds to the new price that the customer shall pay. The crossed-out price shall in every instance be higher than the new one offered by LAST KINGS COLOMBIA, and in the case that it is not, the Client shall only be obliged to pay the lower of the indicated prices. The crossed-out price is published so that the Client can see the deduction to the initial sale price of the Products made at the discretion of LAST KINGS COLOMBIA.

5.4.2. Prices of Products sold by LAST KINGS COLOMBIA under price modality

The prices of Products sold directly by LAST KINGS COLOMBIA shall only be valid and applicable in this modality, and is not applicable to other sales channels of the “Associated Stores”, nor to the Products offered under the marketplace modality (see “TERMS AND CONDITIONS MARKETPLACE MODALITY PRODUCTS SOLD BY THIRD PARTY ASSOCIATED STORES”), nor to physical sales, telephone sales, by catalog or by another website. Below the description of each Product, in every instance, indicates who the supplier is and who is responsible for the dispatch of the Product.

5.4.3. Grouped Product PriceOn the Portal, there is a tool that groups the Products that are available in different colors. However, only the price of the Product that is seen and described in the first image is shown. Due to the foregoing reasons, the Client declares they understand and accept that the price of the Products may change depending on the color they choose.  5.4.4 Typographical Errors LAST KINGS COLOMBIA markets its Products through the Portal, which is defined as a technological platform. In this sense, it is likely that, due to errors in the system or typographical errors, an incorrect price may be presented. The Client declares they understand and accept that in the event that the above occurs, LAST KINGS COLOMBIA shall inform them of such circumstances and may cancel the purchase order(s) that contain the Product(s) for which the price(s) is (are) incorrect, proceeding to return the amount paid.  5.5 Shipping and Delivery 5.5.1. LAST KINGS COLOMBIA markets its Products through the Portal, which is defined as a technological platform. In this sense, it is likely that due to errors in the system or typographical errors, an incorrect price may be presented. The Client declares they understand and accept that in the event that the above occurs, LAST KINGS COLOMBIA shall inform them of such circumstance and may cancel the purchase order(s) that contain the Product(s) for which the price(s) is (are) incorrect, proceeding to return the amount paid.  5.5.2. In the event that the payment of the Product is not processed, it shall be the Client’s responsibility to pay in cash or by dataphone before receiving the Product. It is the Client’s obligation to inspect the Product immediately upon delivery. In the event that the Client detects that the packaging of the Product(s) is damaged or open, they shall proceed to open the package and verify the state of the Products(s), and leave a written record in the presence of the official of the company that provides the transportation service on behalf of LAST KINGS COLOMBIA. Similarly, in the event of any failure, defect or damage to the Product, the customer shall contact the customer service department and report this situation, and deliver the Product available to LAST KINGS COLOMBIA within ninety (90) calendar days as stipulated in “RIGHT OF RETURN”).  5.5.3. Once the Client or the person designated by them, such as the domestic worker or the security guard of the building or residential complex, has received the Product, LAST KINGS COLOMBIA shall not be responsible for the loss or destruction of the Product delivered.  5.5.4. If the delivery of the Product is delayed: i) because the Client refuses to receive it without any justificationii) not having received it within two (2) weeks from the first delivery attempt by the transport service company iii) due to the inability of the company providing the transport service to find the address that has been wrongly provided by the ClientLAST KINGS COLOMBIA may, without prejudice to exercising another right or available resource, not deliver the Product, and consequently proceed to notify the Client that the order has been canceled due to its breach, in which case the whole amount paid shall be reimbursed to the Client.  5.5.5. The cost of shipping the Product shall be established depending on the city or municipality in which the customer wishes to receive the Product, value of the Products, and the type of delivery service chosen. Said value shall be made known to the Client in the summary reflected in the shopping cart at the time of making the transaction on the Portal. There is a shipping service cost for purchases less than $150,000 COP. Said service cost will depend on the location of the address provided by the Client, and the municipality or city ​​where the Client is located. If purchases are equal to or greater than COL$150,000, shipping is totally free for all locations listed by LAST KINGS COLOMBIA as “NATIONAL 1” AND “NATIONAL 2”. The locations that LAST KINGS COLOMBIA designates as “SPECIAL TRAY 1” and “SPECIAL TRAY 2” shall have a cost regardless of the purchase value. The customer can see the shipping price table by city via the available link “Cost table by city”. If the purchase is less than or equal to COL$49,900, the customer will incur a higher shipping cost, which can be calculated via the available link “Cost table by city”.  5.5.6. Special Shipments The company offers the special shipping services described below. LAST KINGS COLOMBIA reserves the right to activate or deactivate such special services at any time and without prior authorization or notice to the Client, as long as the Client has not made a purchase with this service. The cost to be assumed by the Client for these services shall be published in the shopping cart prior to final payment. The Special Shipments are:Same Day Delivery (EMD)This service is available only for same day deliveries in Cali, excluding neighborhoods mentioned in “List of neighborhoods that do not cover this service”. This service shall be active only on business days. For delivery to be made the same day, the purchase shall be made by the customer before 11:59 on the same day. If the purchase is paid online (for example: through credit cards, debit cards, PSE or Baloto), the approval of the transaction carried out by LAST KINGS COLOMBIA payment gateway (provider in charge of processing the company’s online payments) shall be made before 14:00 on the same day. In the event that the transaction is approved after this time, the customer service department shall contact the customer to inform them that their order will be delivered the next day, and that they will be reimbursed, once the Product is delivered and gone through the processes that comply with those the company has established, the amount equivalent to the cost of this special service. For purchases using the cash upon delivery option, there are no conditions of approval. The cost of this service shall be published in the shopping cart prior to final payment. 

Next Day Delivery (EDS)

This service shall be available for deliveries the next day in Cali, excluding the neighborhoods mentioned in “List of neighborhoods that do not cover this service”, and in main cities detailed in “List of active cities nationwide”. This service is tailored depending on whether the delivery is in Cali (hereinafter EDS CALI) or in the cities detailed in “List of active cities nationwide”. (hereinafter National EDS)

EDS CALI

This service shall only be available for next day deliveries in CALI, excluding the neighborhoods mentioned in “List of neighborhoods that do not cover this service”. This service is active from Monday to Thursday. The purchase shall be made by the customer before 23:59 on the day before the expected delivery date. The cost of this service shall be published in the shopping cart prior to final payment.

National EDS

This service shall be available only for deliveries the next day in the cities detailed in “List of active cities nationwide”. This service shall be active only on business days Monday to Thursday. The purchase shall be made by the customer before 11:59 the day before the delivery date. In the event that the purchase is made online (for example: through means of payment such as credit cards, debit cards, PSE or Baloto), the approval of the transaction carried out by LAST KINGS COLOMBIA payment gateway (provider in charge of processing the online payments from the company) shall be made before 14:00 on the same day. In the event that the transaction is approved after this time, the customer service department shall contact the customer to inform them that their order will be delivered the next day, and that they will be reimbursed, once the Product is delivered and gone through the processes that comply with those the company has established, the amount paid equivalent to the cost of this special service. For purchases using the cash upon delivery option, there are no conditions of approval. The cost of this service shall be published in the shopping cart prior to final payment.

  1. INVOICE

The sales invoice, with the details of the transaction carried out by the Client, shall be issued and sent in electronic form to the email with which it was registered on the Portal through the provider authorized by The National Directorate of Taxes and Customs (DIAN). Additionally, it can be downloaded directly by the Client on the Portal by entering their account at “My Orders”.  

  1. 7. RIGHT OF WITHDRAWAL, RETURNS POLICY AND PAYMENT REVERSAL

7.1. Returns

Returns shall be understood as the power of the customer to terminate the contract or withdraw from the contract within ninety (90) calendar days from the date of the delivery of the Product, during which the Client shall return the Products purchased to LAST KINGS COLOMBIA. The Right of Return does not apply to Products for personal use, such as underwear, swimsuits, girdles, stockings, hair accessories, perfumes, creams (including hair Products), cosmetics, earrings and jewelry. Likewise, the Product shall not show signs of use, dirt or wear, be damaged or deteriorated in any way.

7.1.1. Procedure

The Client shall express their willingness to exercise the Right to Return a Product during the term of ninety (90) calendar days following the delivery of the Product. The procedure is detailed step by step, and the Client can view the procedure via https: https://lastkingscol.com the Client can also communicate with LAST KINGS COLOMBIA customer service department using the following means:

Monday to Friday from 08:30 to 18:00, and Saturdays from 08:30 to 17:00. On holidays, LAST KINGS COLOMBIA will be unavailable to attend to customer queries and will respond to the customer’s queries from the first business day following a holiday period.

7.1.2. Refunds

If the Product is to be returned, and was paid with a debit card, the total amount actually paid will be reimbursed by: i) Bank transfer (to the bank account that is provided LAST KINGS COLOMBIA) ii) If the payment was made by credit card, a refund will be requested by the card issuer, and the amount shall be listed on the Client’s statementiii) If the payment was made upon delivery of the Product, the Client shall provide details of the bank account to which the amount paid can be reimbursed. In the event that the Client does not have a bank account, LAST KINGS COLOMBIA shall refund the amount paid through Efecty. The refund of the amount paid by bank transfer or in cash through Efecty shall be made within thirty (30) calendar days following the date that LAST KINGS COLOMBIA receives the returned Products in its warehouse, and in the same condition in which they were delivered to the Client. LAST KINGS COLOMBIA will verify that the Right of Return has been exercised in accordance with the terms and conditions specified in these General Terms and Conditions. In cases where the refund is made to a bank account or through Efecty, the return will be made in the name of the person who made the purchase. In order to avoid fraud, no refund of amount paid shall be made on behalf of third parties. In the event that the Client decides to request the refund by a means of payment other than the one originally used, they shall inform LAST KINGS COLOMBIA at the time of making the request, including at least the information and/or data necessary to make said refund. In the event that the Client decides to request the delivery of a voucher for the value of the Products on which they exercised the right of return, it will be sent to their email no later than six (6) business days following the receipt of said request, and may be used from that day and up to six (6) months after receipt of said voucher. In the event that the agreed term to deliver the Product is breached or when the Product delivered does not correspond to the requested one, the Client shall have the right to request the resolution or termination of the contract, and obtain a full refund. 7.2. PAYMENT REVERSAL The Client may request that the payment of a Product purchased on the Portal be reversed directly when the purchased Product is not received, or the delivered Product does not correspond to what was requested or is defective. If the Client detects that a fraudulent operation was carried out – that is to say that an order in the name of LAST KINGS COLOMBIA was charged to their credit or debit card – they shall contact their bank issuing said card to report said event so that, through the processes of the bank, the corresponding amount paid shall be reimbursed, if it considers it so after carrying out the necessary investigations pertaining to the case.  7.2.1 Procedure: To request the reversal of the payment, the Client shall notify the LAST KINGS COLOMBIA Client service department within five (5) business days following the date on which they should have received a Product and did not receive it. That is, the date on which the Client received a defective Product or one that did not correspond to what was requested. In the latter case, the customer shall return the Product in accordance with the established procedure to exercise the right of return. In both cases, if the payment was made with a credit card, LAST KINGS COLOMBIA shall request the reversal of the payment to the intermediary that provides the service. If the purchase was made with a debit card or other electronic payment method other than a credit card or under the method of payment upon delivery, the amount paid shall be returned by bank transfer (to the bank account that the Client lists with LAST KINGS COLOMBIA). In the event that the Client does not have a bank account, LAST KINGS COLOMBIA shall refund the amount paid through Efecty. In cases where the return is made to a bank account or through Efecty, the return shall be made in the name of the person who made the purchase. In order to avoid fraud, no refund will be made on behalf of third parties. Likewise, notifying LAST KINGS COLOMBIA customer service department of the situations described above does not exempt the responsibility of the customer to notify the issuer of the electronic transaction used to make the purchase. When the payment corresponds to several Products, the Client may request the partial reversal of the payment of those for which the request is made. In this case, the Client shall clearly state what the Product is and the value for which the reversion is requested. Once the Client notifies LAST KINGS COLOMBIA of the reversal request, LAST KINGS COLOMBIA shall notify the intermediary provider to process the electronic transaction(s). In the event that there is a delay in reversing the payment, the issuing entity shall be responsible, and LAST KINGS COLOMBIA shall bear no responsibility.

7.3. WARRANTY

Unless the Portal indicates something different in relation to a particular Product, as a general rule, the Products sold shall have a warranty of one hundred and fifty (150) calendar days or that offered by the manufacturer, whichever is higher. In both cases, said warranty term shall be counted from the date of receipt of the Product by the customer. All Products sold on the Portal have a warranty for the term indicated above. In order to make the warranty effective, it is the Client’s obligation to fully comply with all the conditions and requirements indicated in the “RETURNS POLICY” section set forth in these Terms and Conditions. LAST KINGS COLOMBIA shall have the right to repair or replace the Product, or return the amount paid for the Product. The repaired Product or its replacement with a new one shall be sent to the customer at the address provided in the registry or to the place indicated in writing to the LAST KINGS COLOMBIA customer service department.

The repair, if it can be carried out, shall be carried out within thirty (30) following business days counted from the day after the Product is received in the warehouses of LAST KINGS COLOMBIA. In the event of a delay due to the complexity of the repair, the Client shall be informed. In the event that the Product cannot be repaired or the initial failure persists, the Product shall be replaced with an identical one or one with similar features, or a bonus or refund shall be provided to the Client, depending on what the Client decides. In no case may the features of the Product be inferior to those of the Product that gave rise to the exercise of the terms and conditions of the warranty in the first place. The repairs made to the Products shall have no cost to the Client, and their transportation shall be assumed by LAST KINGS COLOMBIA. If it is decided to replace the Product with an identical one or one with similar features, the exchange shall be made within ten (10) business days following the date on which the Product subject to exchange is received in the warehouses of LAST KINGS COLOMBIA, and the term of the warranty will renew. For refunds, LAST KINGS COLOMBIA shall have up to fifteen (15) business days from the acceptance of the warranty to make the refund. The acceptance of a warranty shall depend on the category of the Product. The following state the validity of the warranty according to each category:

Shoes are not covered by the warranty

Tears, scrapes, rupture of materials (leather, synthetic, textiles), as well as parts that make up the shoe, such as heels, soles, caps, zippers and other accessories of the shoe caused by the wrong use of the Product.

Changes in the color, tonality and texture that are natural to the material of the shoe.

Folds or roughness caused by flexion of the instep.

Products that have already been handled by shoe stores, shoe shops or other third parties, as well as damage caused by improper cleaning and repair.

For all of the above, the Client shall follow the recommendations and instructions for use provided together with the packaging or on the Portal.

Clothing and Accessories

Includes clothing, bags, suitcases, briefcases and all accessories other than jewelry. It is essential to observe the garment care instructions (washing, drying, ironing and use). To make the warranty effective, the garments shall not present changes or modifications of their natural state, nor shall they be damaged as a direct result of the Client’s actions. Under no circumstances is exchange or return of stockings, underwear, pajamas, girdles, swimsuits or hair accessories accepted. Products that have already been manipulated by clothing or accessories repair services or other third parties, as well as damage caused by improper cleaning and repairs do not qualify under the terms and conditions of the warranty. In all cases, the Client shall follow the recommendations and instructions for use provided together with the packaging or on the Portal.

Jewelry

These Products are for special use. They are not designed for laborious work. Contact with water, perfumes, soaps and other chemical Products should be avoided at the time of use. LAST KINGS COLOMBIA is not responsible for the normal deterioration of a Product, nor for the damage that it suffers due to neglect or misuse. Products that have already been manipulated by repair services or other types of third parties, as well as damage caused by improper cleaning and repairs do not qualify under the terms and conditions of the warranty. In all cases, the Client shall follow the recommendations and instructions for use provided together with the packaging or on the Portal. If the warranty is in force, LAST KINGS COLOMBIA is responsible for any factory defects that the Product presents. The terms and conditions of the warranty for these Products shall only apply when a manufacturing error occurs or a material defect is evident.

Watches

To request this warranty, the Products cannot present damage caused by contact with chemicals, by use of batteries not prescribed by the brand, by misuse or by manipulation by repair services other than those endorsed by the Product’s brand, as well as the wear of the strap or other accessories of the watch. The warranty does not cover the life of the battery. For all cases, the customer shall follow the recommendations and instructions for use provided along with the packaging or on the Portal or cited above as causes in which the warranty does not apply, especially those related to the use and maintenance of the watch, as well as water resistance features. Products that have already been manipulated by watchmakers or repair services or other third parties, as well as damage caused by improper cleaning and repair do not qualify under the terms and conditions of the warranty.

7.4. EXCHANGE POLICY

The exchange policy operates under two (2) circumstances:

(i) In the event that the customer acquires the Product and the chosen size is incorrect

(ii) In the case of presenting a Product with defects in quality or suitability that allows for the certain requests as stipulated in the Product’s warranty or by legal guarantee, as the case may be.

7.4.1. Incorrect Size

For a claim regarding incorrect size to proceed, the Product cannot be Products for personal use mentioned in section 7.1 “Right to Return”. The Product to be exchanged shall be unused, with labels in perfect condition and returned in its original packaging. The Client has a term of ninety (90) calendar days following the delivery of the Product to request its exchange, following 7.4.3. “Procedure”.

7.4.2. Defects in Quality and Suitability

For a claim regarding defects in quality and suitability to proceed, the Product shall demonstrate defects in quality or suitability. That is, the Product has manufacturing, processing deficiencies, and/or it is not entirely suitable for the use for which it is intended. Unless otherwise indicated in the LAST KINGS COLOMBIA Portal, the Products sold directly by LAST KINGS COLOMBIA shall have a warranty of one hundred and fifty (150) calendar days or the term offered by the manufacturer of the Product (whichever is higher), from the date of receipt of the Product by the customer. To make a claim under the warranty, the customer shall contact the customer service department (phone, chat or email) and report the damage to the Product. The customer shall make the Product available to LAST KINGS COLOMBIA within fifteen (15) business days following the date of notification of the claim made under the warranty. Once the claim under the warranty has been received, LAST KINGS COLOMBIA shall ensure the Product is delivered to the service points arranged for collection and email the Client who is registered under the purchase order, or who has been informed at the time of making the request. The customer may also request, if possible due to their address, that the Product be collected at the indicated address. In any case, the Client is solely responsible for sending the Product to the LAST KINGS COLOMBIA warehouse in the city of Cali within the aforementioned term. In the event that, due to any circumstance, the exchanged item has not been sent to the Client by the LAST KINGS COLOMBIA customer service department to the service point of their preference, this will not exempt the Client from complying with its obligation to send the Product to the respective warehouses in the terms provided herein.

7.4.3. Procedure

The Client shall enter the web portal https://lastkingscol.com/en/petitions-complaints-claims-and-suggestions/ and follow the steps mentioned there. LAST KINGS COLOMBIA accepts two (2) ways for return of Products:

(i) The Client shall leave the Product at any of the service points, following the procedure established below

(ii) Request the collection in the same place where the Product was delivered

In both cases, the Product shall be in its original packaging, sealed and in the same condition in which it was delivered. Regardless of the return method chosen, the Client shall return the Product subject to exchange to the warehouses of LAST KINGS COLOMBIA, at the latest within fifteen (15) business days following the date on which the request was made. Failure to do so means that the Client has desisted from the exchange request.

7.4.4. Ways in which the Exchange shall be Made

The forms of exchange contemplated by LAST KINGS COLOMBIA are exchange for the same Product, exchange for coupon or refund.

  1. Personal Data Treatment Policy

The POLICY FOR THE PROCESSING OF PERSONAL DATA LMT GROUP S.A.S. is the Policy published at the bottom of the home page of https://lastkingscol.com/ In relation to the Personal Data Treatment Policy of LMT GROUP SAS, the Client declares they understand and accept that once they register on the Portal and/or the mobile application, they accept to receive offers by email and the Personal Data Treatment Policy. There are several ways to receive communication from LAST KINGS COLOMBIA, such as, but not limited to, emails from advertising campaigns, transactional emails, Birthday emails, text messages, push notifications (messages issued by the mobile application), among others. Consequently, in the event that a Client unsubscribes or “Cancels the subscription” in order not to receive further communication from LAST KINGS COLOMBIA or requests the deletion of their personal data, the Client declares they understand and accept that LAST KINGS COLOMBIA shall deactivate or delete their data. However, if the Client has downloaded the mobile application on their mobile phone or tablet, they shall continue to receive the “push notifications” defined as the messages that are displayed on the screen of the mobile phone or tablet that are not text messages, since the only possible ways to prevent their receipt is by blocking the notifications of the application in the mobile phone or tablet settings, or by eliminating the mobile application.

  1. MODIFICATIONS AND SURCHARGES

LAST KINGS COLOMBIA may modify any information contained on this Portal, at any time and without prior notice, until the moment of validation of a transaction, at which point LAST KINGS COLOMBIA is obliged to maintain the conditions initially offered and in force for that moment.

  1. OPERATION OF THE PORTAL

LAST KINGS COLOMBIA

shall do its utmost, to ensure the operation of the Portal is constant and without errors. However, given the nature of the Portal, and given that it operates via the internet, said guarantee cannot be absolute. Thus, LAST KINGS COLOMBIA cannot ensure activity completely free of errors and interruptions. The Client declares they understand and accept that the system under which the Portal operates may present failures, and that LAST KINGS COLOMBIA is not obliged to comply with the purchase orders that have been generated based on these errors.  

 

  1. APPLICABLE LAW

This agreement shall be interpreted in accordance with the laws of the Republic of Colombia, without the possibility of conflicts of law (Private International Law). If any statement of these Terms and Conditions is incomplete, inapplicable, null, non-existent or ineffective, it shall be interpreted within the framework of the same law, and in any case shall not affect the validity and applicability of the remaining stipulations.
